Important!  New legislation changes for high-risk food and feed products
Please be aware of these new border import controls

The 17th January 2023 is a critical date for any importers or shippers of food or animal feeds that are identified as high-risk.

You can see a list of high-risk food and feed products by clicking on this link (https://www.porthealth.uk/import-guidance/non-animal-origin/aflatoxin-list-copy/).

As you can see, the list of high-risk food and feed is extremely comprehensive and is in fact worldwide in its complexity.  If you are involved in any way with importing or shipping any of these products YOU MUST FAMILIARISE YOURSELF with the content and consequences of this list.

The UK Government has published a number of informative documents concerning the affected products, many of which are subject to Chernobyl radiation controls as listed under https://www.legislation.gov.uk/eur/2020/1158/contents

It is important to be aware that any product falling into this category of high-risk food or feed will require a health (CHED-D) certificate, plus the results of sampling and analysis.

The format of the health certificate for these imports can be found at high-risk food and feed not of original origin (NRFNAO): model health certification GOV.UK (https://www.gov.uk/government/publications/high-risk-food-and-feed-not-of-animal-origin-hrfnao-health-certificates

Please note that the document is entitled: “food and feed origination in third countries following the accident at Chernobyl nuclear power station GBHC208X”

You should also be aware that in many cases it is not just the raw material that is covered.  Some processed and compound products containing the controlled product(s) are also covered by import conditions.

For further details please refer to Annexes 1 and 11 of retained Commission Implementing Regulation (EU)2019.1793 : https://www.legislation.gov.uk/eur/2019/1793/contents

Important advice from the Food Standards Agency is that controls apply on the product imported regardless of the CN code used for tariff purposes

Also you must remember … public health is dependent on the level of contaminants present in the product. THIS DOES NOT CHANGE WITH DIFFERENT CN CODES!

At Aerona we strongly recommend that all importers should carefully read the new legislation when bringing FNAOS into the UK.
