New TSA Regulations: Essential Information for Cargo Shipments

New TSA regulations impact cargo shipments on passenger carriers traveling to or through the USA. Effective from September 23rd, 2024, these changes aim to enhance air cargo security and compliance, directly affecting how freight forwarders operate. New TSA regulations impact – key Requirements

Under the new TSA directive, cargo shipments originating from countries designated by the TSA can only be tendered by shippers with whom the freight forwarder has established what is known as an Established Business Relation (EBR). 

This means that shippers must meet specific criteria to ensure their legitimacy and compliance with TSA regulations. 

To comply with these regulations, freight forwarders must verify that all shipments are from shippers that meet one of the following EBR criteria: 

1. Known Consignor: 

The shipper must be recognised as a Known Consignor under the security program of a national authority. 

2. Account Established Prior to September 2nd, 2024: 

If the shipper had an account with the forwarder before the specified date, the forwarder must have documented proof showing one or more of the following: 

– The shipper’s shipping and billing address along with a documented payment or credit history. 

– Recorded sales history that includes relevant contacts or activities. 

– Other forms of documented business correspondence or records. 

3. New Customers After September 2nd, 2024: 

For those shippers who became customers after the cut off date, forwarders must retain and verify the following information: 

– A business or corporate registration certificate, licence, or similar record. 

– Essential business information, including name, address, phone number and email. 

– Authorised point of contact details for the account. 

– Payment information, such as a corporate credit card. 

– A signed contract between the shipper and the forwarder. 

Submitting Confirmation 

To effectively meet TSA requirements, freight forwarders must submit a confirmation declaration through a specific document known as the Freight Forwarder Declaration form. 

This process will be instrumental in ensuring that all concerned parties adhere to the regulations, thereby avoiding any potential shipment refusals or delays.
